BlackBerry App World Money Back Offer - Terms and Conditions

By participating in this Money Back Offer you are deemed to have read and understood these Terms and Conditions and agree to be bound by them.

During the period beginning at 12:00 p.m. EST on December 17, 2009 and ending at 12:00 p.m. EST on January 12, 2010 (“Offer Period”), when you buy two (2) applications from the BlackBerry App World™ storefront within a 24-hour period, PayPal will reimburse your PayPal account for the equal or lesser retail value of the two applications up to a maximum of $15 US plus any fees, costs and applicable taxes levied on the purchase of the application (referred to as, “Money Back Offer”) within 4-6 weeks of the purchases or no later than February 23, 2010.  Offer void where prohibited by law.  BlackBerry App World can be accessed directly from your BlackBerry smartphone, or at www.blackberry.com/appworld.   Limit one (1) Money Back Offer per PayPal account during the Offer Period. The Money Back Offer is not an instant rebate.  PayPal will send you an email notification once your reimbursement has been placed in your PayPal account.  Note: at your option you may request that PayPal transfer the reimbursement from your PayPal account to your credit card, debit card or issue you a cheque for the amount.

To participate in this Money Back Offer, you must: 1) be a legal resident of Canada (except Quebec) or the United States who is the age of majority in the state or territory in which you reside; 2) register for the Money Back Offer on the BlackBerry App World Money Back Money Back Offer page by entering your email address that you use for making App World purchases through PayPal; 3) have a U.S. or Canadian PayPal account which must be in good standing; and 4) complete two (2) purchases (one transaction of two purchases or two consecutive transactions each of one purchase in a 24-hour period) during the Money Back Offer Period.  Persons who are not eligible to participate in the Money Back Offer include: a) residents of Quebec; b) employees of RIM or PayPal; and c) immediate family members (spouses, parents, siblings, children) of RIM or PayPal employees.

RIM and PayPal reserve the right to modify, cancel, terminate or suspend the Money Back Offer in whole or in part, in their sole discretion, in the event of a virus, computer bug or unauthorized human intervention or any other cause that is beyond the control of RIM or PayPal that could corrupt or affect the administration, security, or normal course of the Money Back Offer.  This Money Back Offer cannot be resold, transferred or combined by participant with any other Money Back Offer or discount from RIM or PayPal.  By participating in the Money Back Offer, each participant releases and discharges RIM, PayPal and their respective parents, affiliates, officers, directors, employees, agents, and representatives from any and all liability resulting from (i) late, lost, delayed, stolen, misdirected, incomplete, unreadable, inaccurate, garbled or unintelligible communications, regardless of the method of transmission; (ii) telephone system, telephone or computer hardware, software or other technical or computer malfunctions, lost connections, disconnections, delays or transmission errors; (iii) data corruption, theft, destruction, unauthorized access to or alteration of Money Back Offer data; (iv) any printing, typographical, administrative or technological errors in any materials associated with the Money Back Offer; or (v) any liability for damage to any computer system or device resulting from participating in, or accessing or downloading information in connection with the Money Back Offer, which could limit or prevent the opportunity of any eligible person from entering or participating in the Money Back Offer or receiving a reimbursement.  By completing and submitting the information requested to participate in the Money Back Offer to Research In Motion Limited and/or its affiliated companies (“RIM”) or service providers on behalf of RIM, you consent to the collection, use, and disclosure of your personal information by RIM or its service providers on RIM’s behalf for the purposes of: (i) its internal use; (ii) to facilitate your participation in the Money Back Offer; and (iii) if you have so elected, to allow RIM or its service providers on RIM’s behalf to provide you with information on RIM and/or BlackBerry products, services or offers.  You further consent to RIM or its representatives sharing your information, namely your email address, with PayPal for the purposes of PayPal executing and administering the Money Back Offer.  The collection, use and disclosure of any personal information you provide to RIM is subject to RIM’s Privacy Policy which is set out at: http://na.blackberry.com/eng/legal/privacy_policy.jsp, and any collection, use and disclosure of any personal information you provide to PayPal is subject to PayPal’s Privacy Policy which is set out at: https://cms.paypal.com/cgi-bin/marketingweb?cmd=_render-content&content_ID=ua/Privacy_full&locale.x=en_US.  These Terms and Conditions shall be governed by and construed under the laws of the Province of Ontario without regard to conflict of laws principles. You irrevocably waive any objection on the grounds of venue, forum non-conveniens or any similar grounds and irrevocably consent to service of process by mail or in any other manner permitted by applicable law and consent to the jurisdiction of the courts in the Province of Ontario.  You further hereby waive any right to a trial by jury with respect to any lawsuit or judicial proceeding arising or relating to these Terms and Conditions.
